Shipping Policy Dietpillsuperstore.com ships exclusively with UPS and can only deliver to addressed confirmed deliverable by UPS. This typically excludes PO Boxes, AFO/AFE addresses and any international addresses. Dietpillsuperstore.com shall not be responsible for delivery errors or losses caused by UPS. In the event that a package is lost by UPS, a claim will be filed by Dietpillsuperstore.com. If UPS determines that the package is not recoverable, an insurance claim will be filed with UPS. The maximum insured amount is $100 USD. In the event that UPS loses a package and the insurance claim is successful, the customer will be reimbursed for product costs (up to $100) and the shipping costs. 11. Return Policy All Sales are final on Ephedra Products. No refunds or exchanges will be made for Ephedra products. Dietpillsuperstore.com will accept returns on UNOPENED products for up to 30 days after you have received them for a full refund of the original purchase price (not including original shipping fee). We WILL NOT, under any circumstances, accept any returns on already opened items. Since every individual has a different perception of what does and doesn't taste good, opened products will not be accepted for return as a result of dissatisfaction with taste, dissatisfaction with product results, etc. Dissatisfaction with opened containers must be handled directly with the manufacturer of the product. Once we receive your items we will issue a refund in the form of a credit to your credit card. Shipping and handling charges are non-refundable and the purchaser will pay for return shipping. No product returns will be accepted after 30 days. ALL RETURNS MUST BE PROPERLY INSURED AND TRACKING NUMBERS PROVIDED BY CUSTOMER AS PROOF OF RETURN. If your return is not insured properly and gets lost or damaged in transit, we cannot issue a refund. In the event that any of your products arrive damaged, please contact us via e-mail at orders@dietpillsuperstore.com, and we will file a claim with the carrier for a damaged shipment. Please include your order number, daytime phone number, and the nature of the damages. You have the option of either receiving a replacement or a full refund once the claims process is complete. Before returning a product, you must contact us for a Return Merchandise Authorization (RMA) number by sending an e-mail to orders@dietpillsuperstore.com and provide the following information: 1. Your order number 2. Your name 3. The product(s) being returned 4. Reason(s) for return 5. Daytime phone number 6. Your e-mail address Dietpillsuperstore.com will issue you an RMA number. You must write this RMA number on your invoice and include it in your return package.All shipments returned without a valid RMA number will be refused. 12. Representations and Warranties; Limitation of Liability THE SITE IS PRESENTED "AS IS." WE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND WHATSOEVER, EXPRESS OR IMPLIED, IN CONNECTION WITH THESE TERMS AND CONDITIONS OR THE SITE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT OR FITNESS FOR A PARTICULAR PURPOSE, EXCEPT TO THE EXTENT SUCH REPRESENTATIONS AND WARRANTIES ARE NOT LEGALLY EXCLUDABLE. IN NO EVENT SHALL OUR MAXIMUM AGGREGATE LIABILITY EXCEED ONE HUNDRED DOLLARS ($100.00). 13. Indemnification You agree to defend, indemnify and hold us harmless for any loss, damages or costs, including reasonable attorneys' fees, resulting from any third party claim, action, or demand resulting from your use of the Site. You also agree to indemnify us for any loss, damages, or costs, including reasonable attorneys' fees, resulting from your use of software robots, spiders, crawlers, or similar data gathering and extraction tools, or any other action you take that imposes an unreasonable burden or load on our infrastructure. 14. Disputes With respect to any dispute regarding the Site, all rights and obligations and all actions contemplated by these Terms and Conditions shall be governed by the laws of Texas, as if the Terms and Conditions were a contract wholly entered into and wholly performed within Texas. Any dispute relating in any way to your visit to the Site shall be submitted to confidential arbitration in Texas, except that, to the extent you have in any manner violated or threatened to violate our intellectual property rights or the intellectual property rights of our affiliates, partners or licensors, we may seek injunctive or other appropriate relief in any court and you consent to exclusive jurisdiction and venue in any such court. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise. 15. General You acknowledge and agree that these Terms and Conditions, which include our Privacy Policy, constitute the complete and exclusive agreement between us concerning your use of the Site, and supersede and govern all prior proposals, agreements, or other communications.
